 சமீபத்திய வளர்ச்சியில், ஒரே கிரிமினல் வழக்கில் இருந்து எழும் ஜாமீன் மனுக்களை வெவ்வேறு தனி நீதிபதிகள் முன் பட்டியலிடும் அலகாபாத் உயர் நீதிமன்றத்தின் நடைமுறைக்கு உச்ச நீதிமன்றம் அதிருப்தி தெரிவித்தது.

நீதிபதிகள் பி.ஆர்.கவாய், சி.டி.ரவிக்குமார் மற்றும் பி.வி.சஞ்சய் குமார் ஆகியோர் அடங்கிய உச்ச நீதிமன்ற அமர்வு, இத்தகைய நடைமுறை சீரற்ற விளைவுகளுக்கு வழிவகுத்தது மற்றும் முரண்பாடான சூழ்நிலைகளை உருவாக்கியது.

Supreme Court Expresses Concern Over Practice in Allahabad HC of Listing Bail Plea in Same FIR Before Different Judges

In a recent development, the Supreme Court expressed its dissatisfaction with the Allahabad High Court’s practice of listing bail applications arising from the same criminal case before different single judges.

The Supreme Court bench, comprising Justices BR Gavai, CT Ravikumar, and PV Sanjay Kumar, observed that such a procedure led to inconsistent outcomes and created anomalous situations.

Justice Gavai questioned the practice during the proceedings, noting that in some instances, one judge granted bail while another did not.

The Court subsequently recorded its concern in its order, directing the Registrar General of the Supreme Court to inform the Allahabad High Court about this issue.

The Court highlighted the existence of several Allahabad High Court orders where different judges presided over bail pleas arising from the same First Information Report (FIR). This resulted in a lack of uniformity, with some accused being granted bail while others were denied.

The Supreme Court expressed its discontent with this disparity, emphasizing the need for consistency in such matters.

The concern was raised while granting bail to Sajid, who was charged with armed rioting. Sajid, represented by advocate Ankur Yadav, filed an appeal challenging a December 6 order of the Allahabad High Court.
