 Hindi Is National Language; Witnesses from West Bengal Expected to Communicate Before UP Court in Hindi: Supreme Court

In a recent ruling, the Supreme Court of India rejected a Transfer Petition filed under Section 25 of the Code of Civil Procedure Code, 1908, by Pramod Sinha, seeking the transfer of a claim petition before the Motor Accident Claims Tribunal (MACT), Farrukhabad at Fatehgarh, U.P. 

The case, Transfer Petition(s), was heard by the Justice Dipankar Datta on 31st July 2023.

Pramod Sinha, the petitioner in the case, was the owner of the vehicle involved in the accident, and he sought the transfer of the claim petition to the MACT in Darjeeling, West Bengal. However, the court, after considering the arguments presented by the petitioner’s counsel, Mr. Sameer Sodhi, Mr. Mahesh Kumar, Mr. Amanpreet Singh Rahi, Mr. Nikhilesh Kumar, Mr. Sunit Kumar Toppo, Ms. Devika Khanna, Mrs. V D Khanna, and Mr. Vmz Chambers, AOR, held that the claimants had the option to choose the MACT jurisdiction based on their residence, place of business, or the defendant’s residence.

The court, in its order, stated, “The provisions of the Act do not make it mandatory for the claimants to lodge an application for compensation under Section 166 thereof before the MACT having jurisdiction over the area where the accident occurred. On the contrary, sub-section (2) of Section 166 provides an option for the claimants to approach the MACT within the local limits of whose jurisdiction they (claimants) reside or carry on business or the defendant resides. The claimants having chosen the option to approach the MACT, Farrukhabad at Fatehgarh, U.P., a forum that law permits them to choose, no grievance can be raised by the petitioner. The contention is misconceived and, hence, stands overruled.”

The petitioner also argued that language could be a barrier since all the witnesses were from Siliguri. However, the court rejected this contention, emphasizing that Hindi, being the national language, should be used for communication during the proceedings. 

The court stated, “In a country as diverse as India, it is no doubt true that people speak different languages. There are at least 22 (twenty-two) official languages. However, Hindi being the national language, it is expected of the witnesses who would be produced by the petitioner before the MACT, Fatehgarh, U.P., to communicate and convey their version in Hindi. If the contention of the petitioner is to be accepted, it is the claimants who would be seriously prejudiced not being in a position to communicate and convey their version in Bengali.”

Consequently, the Supreme Court dismissed the Transfer Petition, finding no valid grounds for the transfer, and disposed of any pending applications.
