Kallakurichi Poisoned Liquor Case: Supreme Court Orders CBI to Investigate

The Supreme Court has ruled that there is no bar to the CBI to investigate the Kallakurichi poisoned liquor case.

The judges have ordered the dismissal of the Tamil Nadu government's appeal.

New Delhi: 68 people died after consuming poisoned liquor in the Karunapuram area of ​​Kallakurichi last June. The C.P.C.I.D. police were investigating the incident that caused great shock across the country.

Meanwhile, cases were filed in the Madras High Court on behalf of the AIADMK, the DMK and the BJP to transfer the case to the CBI. The bench comprising Justices Krishnakumar and Balaji, which heard these cases, ordered the transfer of the cases related to the Kallakurichi poisoned liquor death to the CBI on November 20.

Subsequently, Advocate D. Kumanan filed an appeal in the Supreme Court on behalf of the Tamil Nadu government against this order of the Madras High Court and seeking an interim stay on the High Court order. In it, the appeal petition urged that if the poisonous liquor case is handed over to the CBI, it will delay the completion of its investigation and that the Tamil Nadu Police should be allowed to continue the investigation.

In this situation, this petition came up for hearing today in a session comprising Justices J.P. Parthiwala and R. Mahadevan. At that time, the Tamil Nadu Police had completed the investigation in the Kallakurichi case. The judges, who said that they did not want to interfere with the Madras High Court decision, dismissed the Tamil Nadu government's appeal and ordered.

Furthermore, there is no bar on the CBI investigating the Kallakurichi poisonous liquor case. They said that the CBI can conduct the investigation.

தமிழக அரசின் மேல்முறையீட்டு மனுவை தள்ளுபடி செய்து நீதிபதிகள் உத்தரவிட்டனர்.

புதுடெல்லி:  கள்ளக்குறிச்சி கருணாபுரம் பகுதியில் கடந்த ஜூன் மாதம் விஷச்சாராயம் குடித்து 68 பேர் பலியானார்கள். நாடு முழுவதும் பெரும் அதிர்ச்சியை ஏற்படுத்திய இச்சம்பவம் குறித்து சி.பி.சி.ஐ.டி. போலீசார் விசாரணை நடத்தி வந்தனர்.  

இதற்கிடையே, இந்த வழக்கை சிபிஐக்கு மாற்றவேண்டும் என அ.தி.மு.க, தே.மு.தி.க, பா.ஜ.க. சார்பில் சென்னை ஐகோர்ட்டில் வழக்குகள் தாக்கல் செய்யப்பட்டன. இந்த வழக்குகளை விசாரித்த நீதிபதிகள் கிருஷ்ணகுமார் மற்றும் பாலாஜி ஆகியோர் அடங்கிய அமர்வு, கள்ளக்குறிச்சி விஷ சாராய மரணம் தொடர்பான வழக்குகளை சி.பி.ஐ. விசாரணைக்கு மாற்றி நவம்பர் 20-ம் தேதி உத்தரவிட்டது.

இதையடுத்து, சென்னை ஐகோர்ட்டின் இந்த உத்தரவை எதிர்த்தும், ஐகோர்ட் உத்தரவுக்கு இடைக்கால தடை விதிக்கக் கோரியும் சுப்ரீம் கோர்ட்டில் தமிழ்நாடு அரசின் சார்பில் வக்கீல் டி.குமணன் மேல்முறையீட்டு மனு தாக்கல் செய்தார். அதில் விஷ சாராய வழக்கை சி.பி.ஐ. வசம் ஒப்படைத்தால் அதன் விசாரணை முடிய காலதாமதம் ஆகும் என்றும், தமிழ்நாடு காவல்துறையே விசாரணையை தொடர்ந்து நடத்த அனுமதிக்க வேண்டும் என்றும் மேல்முறையீட்டு மனுவில் வலியுறுத்தப்பட்டு இருந்தது.

இந்நிலையில், இந்த மனு நீதிபதிகள் ஜே.பி.பார்திவாலா, ஆர்.மகாதேவன் ஆகியோர் அடங்கிய அமர்வில் இன்று விசாரணைக்கு வந்தது. அப்போது கள்ளக்குறிச்சி வழக்கில் தமிழக காவல்துறை விசாரணையை முடித்துவிட்டது. சென்னை ஐகோர்ட் முடிவில் தலையிட விரும்பவில்லை எனக்கூறிய நீதிபதிகள், தமிழக அரசின் மேல்முறையீட்டு மனுவை தள்ளுபடி செய்து உத்தரவிட்டனர்.  

மேலும், கள்ளக்குறிச்சி விஷ சாராய வழக்கை சி.பி.ஐ. விசாரிக்க தடையில்லை. சி.பி.ஐ. விசாரணையை நடத்தலாம் என தெரிவித்தனர்.

 

कल्लाकुरिची विशसराय मामला: सुप्रीम कोर्ट ने दिया सीबीआई जांच पर रोक नहीं लगाने का आदेश

सुप्रीम कोर्ट ने कहा है कि कल्लाकुरिची जहरीली शराब मामले की जांच करने से सीबीआई को कोई रोक नहीं है।

जजों ने तमिलनाडु सरकार की अपील खारिज कर दी.

नई दिल्ली: पिछले साल जून में कल्लाकुरिची करुणापुरम इलाके में शराब के जहर से 68 लोगों की मौत हो गई थी. पूरे देश को गहरा सदमा पहुंचाने वाली इस घटना के बारे में सी.पी.सी.आई.डी. पुलिस जांच कर रही थी.

इस बीच एडीएमके, डीएमडीके, बीजेपी ने मांग की कि इस केस को सीबीआई को ट्रांसफर किया जाए. चेन्नई उच्च न्यायालय में मामले दायर किए गए। न्यायमूर्ति कृष्णकुमार और न्यायमूर्ति बालाजी की पीठ ने इन मामलों की सुनवाई की और फैसला किया कि सीबीआई को कल्लाकुरिची जहर से हुई मौत के मामलों को लेना चाहिए। मुकदमे को 20 नवंबर तक के लिए भेज दिया गया।

इसके बाद, वकील डी. कुमानन ने चेन्नई हाई कोर्ट के इस आदेश के खिलाफ तमिलनाडु सरकार की ओर से सुप्रीम कोर्ट में अपील दायर की और हाई कोर्ट के आदेश पर अंतरिम रोक लगाने की मांग की। जहरीली शराब मामले में सी.बी.आई. अपील में इस बात पर जोर दिया गया कि अगर कब्जा सौंप दिया गया तो इसकी जांच पूरी होने में देरी होगी और तमिलनाडु पुलिस को जांच जारी रखने की इजाजत दी जानी चाहिए.

ऐसे में आज जस्टिस जेपी पार्थीवाला और आर महादेवन की बेंच में यह याचिका सुनवाई के लिए आई। फिर तमिलनाडु पुलिस ने कल्लाकुरिची मामले की जांच पूरी की. न्यायाधीशों ने कहा कि वे चेन्नई उच्च न्यायालय के फैसले में हस्तक्षेप नहीं करना चाहते हैं और तमिलनाडु सरकार की अपील खारिज कर दी.

साथ ही कल्लाकुरिची जहरीली शराब मामले की जांच भी सीबीआई ने की थी. बेझिझक पूछताछ करें. सीबीआई उन्होंने कहा कि जांच करायी जा सकती है.
