2019 கிரிமினல் அவதூறு வழக்கில் ராகுல் காந்தியின் மோடி குடும்பப் பெயரைக் குறிப்பிட்டதற்காக அவருக்கு விதிக்கப்பட்ட தண்டனையை எஸ்சி நிறுத்தி வைத்தார்

2019 ஆம் ஆண்டு மோடியின் குடும்பப் பெயரைப் பற்றி அவதூறு செய்த வழக்கில் காங்கிரஸ் தலைவர் ராகுல் காந்திக்கு விதிக்கப்பட்ட தண்டனையை உச்சநீதிமன்றம் வெள்ளிக்கிழமை நிறுத்தி, அவரது எம்பி அந்தஸ்தை மீட்டெடுத்தது.

நீதிபதிகள் பி.ஆர்.கவாய், பி.எஸ்.நரசிம்ஹா மற்றும் சஞ்சய் குமார் ஆகியோர் அடங்கிய மூன்று நீதிபதிகள் கொண்ட அமர்வு, பேச்சு வார்த்தைகள் நல்ல ரசனையுடன் இல்லை என்றும், பொது வாழ்வில் உள்ள ஒருவர் பொதுப் பேச்சுகளில் எச்சரிக்கையாக இருக்க வேண்டும் என்றும் சந்தேகமில்லை என்று கூறியது.

"அதிகபட்ச தண்டனை விதிப்பதற்கான எந்த காரணமும் விசாரணை நீதிபதியால் வழங்கப்படவில்லை, இறுதி தீர்ப்பு நிலுவையில் உள்ள தண்டனையின் உத்தரவு நிறுத்தப்பட வேண்டும்" என்று பெஞ்ச் கூறியது.

குஜராத் உயர் நீதிமன்றத்தின் தீர்ப்பை எதிர்த்து காந்தியடிகள் தாக்கல் செய்த மனுவை உச்ச நீதிமன்றம் விசாரித்து வந்தது, இது அவரது “மோடி குடும்பப்பெயர்” குறித்த அவதூறு வழக்கில் தனக்கு விதிக்கப்பட்ட தண்டனைக்கு தடை விதிக்கக் கோரிய அவரது மனுவை நிராகரித்தது.

SC stays conviction of Rahul Gandhi in 2019 criminal defamation case over his Modi surname remark

The Supreme Court on Friday stayed the conviction of Congress leader Rahul Gandhi in a 2019 defamation case over his Modi surname remark, restoring his status as an MP.

A three-judge bench of Justices B R Gavai, P S Narasimha and Sanjay Kumar said no doubt that the utterances were not in good taste and that a person in public life is expected to exercise caution while making public speeches.

“No reason has been given by the trial judge for imposing maximum sentence, the order of conviction needs to be stayed pending final adjudication,” the bench said.

The top court was hearing a plea by Gandhi challenging the Gujarat High Court verdict which dismissed his plea seeking a stay on his conviction in a defamation case over his “Modi surname” remark.

Former Gujarat minister Purnesh Modi had filed a criminal defamation case in 2019 against Gandhi over his “How come all thieves have Modi as the common surname?” remark made during an election rally in Kolar in Karnataka on April 13, 2019.
