 இறக்கும் உரிமை

காமன் காஸ் வி யூனியன் ஆஃப் இந்தியா (1999) இல், வாழும் உரிமை என்பது கண்ணியத்துடன் இறப்பதற்கான உரிமையையும் உள்ளடக்கியது என்று கூறப்பட்டது. எனவே, தகவலறிந்த முடிவெடுக்கும் மன திறன் கொண்ட ஒரு வயது வந்தவர் மருத்துவ சிகிச்சையை மறுக்கலாம் அல்லது வாழ்க்கை ஆதரவு அமைப்புகளை திரும்பப் பெறக் கோரலாம். அதில் ‘வாழும் விருப்பம்’ என்ற கருத்தும் அறிமுகப்படுத்தப்பட்டது.

 

Right to Die

In Common Cause v Union of India (1999), it was held that the right to life includes the right to die with dignity. Thus, an adult with the mental capacity to make an informed decision may refuse medical treatment or request the withdrawal of life-support systems. The concept of ‘living will’ was also introduced in it.
