 இந்த பதவி உயர்வுகளின் சட்டபூர்வமான தன்மை குறித்த மனு ஏற்கனவே நிலுவையில் உள்ள நிலையில் குஜராத் அரசு ஒரு அறிவிப்பை வெளியிட்டுள்ளது என்று உச்ச நீதிமன்றம் கூறியது.

 புதுடெல்லி: குஜராத் அரசு மாவட்ட நீதிபதிகளை நியமித்த 68 நீதித்துறை அதிகாரிகளின் பதவி உயர்வுக்கு உச்சநீதிமன்றம் தடை விதித்துள்ளது.

 தகுதி மற்றும் சீனியாரிட்டி மற்றும் தகுதித் தேர்வில் தேர்ச்சி பெற்றதன் அடிப்படையில் பதவி உயர்வுகள் செய்யப்பட வேண்டும். உயர் நீதிமன்றத்தின் பரிந்துரைகளும் அதைத் தொடர்ந்து அரசு அறிவிப்புகளும் சட்டவிரோதமானது” என்று உச்ச நீதிமன்றம் கூறியது.

 இந்த விவகாரத்தில் இந்த நீதிமன்றம் விசாரணைக்கு வந்ததும், நோட்டீஸ் பிறப்பித்து விரிவான உத்தரவு பிறப்பிக்கப்பட்டதும், அரசு பதவி உயர்வு உத்தரவை ஏற்று நிறைவேற்றிய அவசரத்தையும் அவசரத்தையும் நாங்கள் பாராட்டவில்லை. 2022 ஆம் ஆண்டிற்கான தேர்வு என்பது குறிப்பிடத்தக்கது, எனவே பதவி உயர்வு உத்தரவை நிறைவேற்றுவதில் அசாதாரண அவசரம் எதுவும் இல்லை, ”என்று அது கூறியது.

SC Stays Promotion of 68 Gujarat Judicial Officers

The apex court said that the Gujarat government had issued a notification while a plea on the legality of these promotions is already pending.

New Delhi: The Supreme Court has stayed the promotion of 68 judicial officers who appointed district judges by the Gujarat government.

Promotions must be made on principle of merit-cum-seniority and on passing a suitability test. Recommendations by high court and subsequent government notification are illegal,” the Supreme Court said.

We do not appreciate the haste and hurry in which the State has approved and passed the promotion order when this court was seized with the matter and a detailed order was passed issuing notice. It is to be noted that the selection was of the year 2022, therefore there was no extraordinary urgency in passing the promotion order,” it said.
